Wituka Art for Everyone SL - B90273103 informs users of this website about its policy regarding the processing and protection of personal data that may be collected through its website, by browsing it, sending contact forms, consultation or subscription, contracting services or purchase of products, or those provided by any other means such as email, forms for requesting a quote in paper format and any other document.

Who is responsible for the processing of your personal data?

Wituka Art for Everyone SL is the Responsible for the processing of the User's personal data and informs you that these data will be treated in accordance with the provisions of the European and Spanish regulations in force on the protection of personal data, Regulation (EU) 2016/679, of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and the Organic Law (ES) 3/2018, of 5 December, on Data Protection and Guarantee of Digital Rights (LOPDGDD).

What do we process your personal data for and why do we do it?

Depending on the web form where we have obtained your personal data, we will treat them confidentially to achieve the following purposes:

1. Sending advertising

Send commercial advertising communications by e-mail, fax, SMS, MMS, social communities or any other electronic or physical means, present or future, that enable commercial communications. These communications will be made by the responsible party and related to its products and services, or those of its collaborators or suppliers with whom it has reached a promotional agreement. For how long will we keep your personal data?

To whom do we provide your personal data?

In the latter case, the data may be communicated to our service providers related to communications and marketing, with whom the Data Controller has signed the confidentiality and processing assignment contracts required by the privacy regulations in force.

There will also be a transfer of data to service providers responsible for logistics and delivery of documentation / orders, necessary for the execution of the contract delivery services.

We inform you that in this case international data transfer is made to the following entities for the purposes described:

2.- MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER:

By ticking the corresponding boxes and entering the data in the fields marked with an asterisk (*) in contact forms, registration, subscription, etc., or submitted in download forms, the User expressly and freely and unequivocally accepts that his/her data are necessary to meet his/her request by the Responsible, being voluntary the inclusion of data in the remaining fields.

All data requested through the website and marked with (*) are mandatory because they are necessary for the provision of optimal service to the User. The rest of the fields, although optional, it may be convenient to fill them in in order to have all the necessary information to adequately answer your query. If all the data is not provided, there is no guarantee that the information and services provided by the Provider will be completely tailored to your needs.

The User guarantees that the personal data provided to the Provider are truthful and is responsible for communicating any modification thereof.

3.- SECURITY MEASURES


That in accordance with the provisions of the regulations in force on personal data protection, the Controller is complying with all the provisions required for the processing of personal data under its responsibility, and manifestly with the principles described in Article 5 of the RGPD and Title II of the LOPDGDD, whereby they are processed in a lawful, fair and transparent manner in relation to the data subject and that they are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

The Provider guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the RGPD and the LOPDGDD in order to protect the rights and freedoms of the Users and has communicated the appropriate information to them so that they can exercise them.

Who is responsible for processing your personal data? Wituka Art for Everyone SL, hereinafter referred to as the CONTROLLER, informs the USER that it has created profiles on major social media platforms such as Facebook, Instagram, Twitter, LinkedIn, YouTube, Vimeo, etc., and that it is responsible for processing the user's personal data on these platforms. Therefore, the CONTROLLER informs you that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD), providing the following processing information:

Why do we process your personal data? Processing purpose: to maintain a relationship between the USER and the CONTROLLER, which may include the following actions: • Processing requests and inquiries submitted to the CONTROLLER. • Informing about activities and events organized by the CONTROLLER. • Informing about products or services offered by the CONTROLLER. • Interacting through official profiles.

Why are we allowed to process your personal data? Legal basis for processing: Article 6.1.a GDPR, the data subject has given consent for processing their personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the CONTROLLER's network, thus showing interest in the published information. Therefore, by requesting to follow our official profiles, the USER gives their consent for the processing of personal data published in their profile.

The USER can access the privacy policies of each social network at any time and configure their profile to ensure their privacy.

The CONTROLLER has access to and processes the USER's public information, particularly their contact name. These data are only used within the social network and will only be added to a file of the CONTROLLER when necessary to process the USER’s request.

How long will we keep your personal data? Data retention criteria: data will be retained as long as the USER does not revoke the consent given, as indicated in this privacy policy.

Who do we share your personal data with? Data disclosure: The information provided by the USER through the CONTROLLER's social networks, including personal data, may be published based on the services the USER utilizes, making it publicly available to other third-party users of the social networks. Through each social network’s profile, the USER can configure what information they want to make public, review granted permissions, remove or deactivate them, and manage third-party applications they no longer wish to use.

No personal data will be transferred to third parties outside the social network unless it is essential for the development and execution of the processing purposes, in which case it will be shared with our communication service providers, with whom the CONTROLLER has confidentiality and data processing agreements as required by current privacy regulations.

What are your rights? Rights of the USER: These rights can only be exercised in relation to the information under the CONTROLLER’s control. • Right to withdraw consent at any time. • Right of access, rectification, portability, and erasure of personal data, as well as the right to restrict or object to processing. • Right to file a complaint with the supervisory authority (www.aepd.es) if the USER believes that data processing does not comply with current regulations.

2. USE OF THE PROFILE The CONTROLLER will carry out the following actions: • Access public profile information. • Publish on the USER's profile all information already posted on the CONTROLLER’s social network. • Send personal and individual messages through social media channels. • Post page status updates that will appear on the USER’s profile.

The USER can always control their connections, remove content that is no longer of interest, and restrict who they share connections with by accessing their privacy settings.

3. PUBLICATIONS Once the USER follows or joins the CONTROLLER's social network, they may publish comments, links, images, photographs, or any other multimedia content supported by the platform. The USER must, in all cases, be the owner of the published content, hold the copyright and intellectual property rights, or have the consent of affected third parties.

Any publication on the social network, including texts, graphics, photographs, videos, etc., that is offensive, immoral, unethical, or in bad taste, or that violates intellectual or industrial property rights, image rights, or the law, is expressly prohibited.

In such cases, the CONTROLLER reserves the right to remove the content immediately without prior notice and may request the USER's permanent blocking.

The CONTROLLER is not responsible for content freely posted by a USER.

The USER should be aware that their publications will be visible to other users, making them primarily responsible for their privacy.

Images posted on the social network will not be stored in any file by the CONTROLLER but will remain on the social network.

4. DATA OF MINORS OR PERSONS WITH SPECIAL NEEDS Access and registration through the CONTROLLER’s social networks are prohibited for individuals under 18 years of age. If the USER has special needs, the intervention of their legal guardian, tutor, or legal representative with a valid document proving representation will be required.

The CONTROLLER is expressly exempt from any liability that may arise from the use of social networks by minors or persons with special needs. The CONTROLLER's social networks do not knowingly collect personal information from minors. Therefore, if the USER is underage, they must not register, use the CONTROLLER's social networks, or provide any personal information.
